The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Mitchell Smith.
Mitchell Smith is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The Pinball Defense Force app stores and processes personal data that you have provided to us, in order to provide my Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Pinball Defense Force app won’t work properly or at all.

You should be aware that there are certain things that Mitchell Smith will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Mitchell Smith cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Mitchell Smith cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Mitchell Smith cannot accept responsibility.
With respect to Mitchell Smith’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Mitchell Smith accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app may be offered on more than one platform, and the requirements of each platform — and of any additional platforms we decide to extend the app to — may change, so you will need to download the updates if you want to keep using it. Mitchell Smith does not promise that the app will always be updated so that it stays relevant to you, or that it will keep working with the version of the operating system you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
In-App Purchases
Pinball Defense Force is free to download and is supported by advertising. It also offers one optional in-app purchase, Remove Ads, which turns off the ads shown in the app. It is a one-time purchase and not a subscription: there are no recurring charges and there is nothing to cancel. The price is the one shown in the App Store at the time you buy, and it can differ by country and change over time.
Purchases are sold and billed by Apple through the App Store. Apple handles payment, purchase history, restores and refunds, and Apple's terms and refund policy apply to the transaction itself. Buying Remove Ads changes the advertising only. It does not unlock extra levels, modes or content, and the rest of Pinball Defense Force works the same way either way.
Advertising
Unless you have bought Remove Ads, the app displays advertising supplied by Google AdMob. The ads come from third parties: I do not choose, write or endorse the individual ads you see, and I am not responsible for the products, services or websites they lead to. Where your device's operating system requires it, you will be asked for permission before any tracking takes place, and you can change that choice at any time in your device settings. What data is involved is described in the Privacy Policy.
Game Center and Leaderboards
Signing in to Game Center is optional and is only needed to appear on a leaderboard. Game Center is Apple's service and is governed by Apple's terms; scores and rankings are handled by Apple, not by me. I may reset a leaderboard or remove a score that appears to have been obtained by cheating or by modifying the app.
Who Can Use the App
Pinball Defense Force is meant for a general audience. If you are below the age at which you can agree to terms like these where you live, a parent or guardian has to agree to them on your behalf, and by letting you use the app they accept these terms for you. Purchases should only be made with the permission of whoever owns the Apple Account being charged.
The App Is Provided "As Is"
The app is provided as it is, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. I do not promise that the app will be uninterrupted or error-free, or that saved data, high scores or unlocked content will never be lost. Where the law of your country does not allow some of these exclusions, they apply to you only as far as it does.
Limit of Responsibility
So far as the law allows, Mitchell Smith is not liable for any indirect, incidental, special or consequential loss arising out of your use of the app, and total liability for any claim connected with the app is limited to what you actually paid for it in the twelve months before the claim — which, for a free download with no purchase, is nothing. Nothing in these terms limits any liability that cannot lawfully be limited.
Governing Law
These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law rules, and the courts of Maryland have jurisdiction over any dispute. If the law of the country you live in gives you the right to bring a claim there, these terms do not take that right away.
Changes to This Terms and Conditions
I may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page.
